Govt drafting rules to revoke land concession


 

JAKARTA. The government becomes more serious in realizing agrarian reform programs. Recently, now the Ministry of Agricultural and Spatial Planning (ATR) / National Land Agency is preparing a regulation in the form of ministerial regulation stipulating the revocation of the land concession (HGU) of the company-owned lands, which have not been used after the permission was granted.

Director General of Spatial Planning of the Ministry of Agrarian and Spatial Budi Situmorang said that the ministerial regulation, which will set some provision of the concession’s revocation, is targeted to be completed in 2017. "To date, land mapping is being conducted at the regency / municipal levels," he said.

According to him, the revocation is essential to improve the spatial planning in accordance with agrarian reform. The spatial planning is also essential to prevent speculators, who have played and caused the land prices to soar.

Infrastructure lands
Aside of improving the spatial planning, the revocation of the companies-owned HGU, which is not used accordingly, is also important in supporting the government’s land banking, mainly for the infrastructure projects. To date, a number of government infrastructure projects were obstructed by the lack of lands provisions.

According to Budi, the revocation will affect to the unused HGU, as well as to the lands, which are not used accordingly. “We will take over the idle lands,” Budi said.

The plan will apply in a retroactive manner. Therefore, if the companies fail to utilize the HGU in an optimum manner, the license may be revoked by the government. However, the revocation will be implemented in accordance with some tight requirements, Budi said.

As information, President Joko Widodo had placed the agrarian reform as one of priorities. Under the scheme of agrarian reform, the government will target to redistribute the abandoned and unused lands to the farmers, as well as to legalize the state owned lands.

However, Secretary General of Consortium of Agrarian Reform Iwan Nurdin said that the agrarian reform has not yet run as expected. The land redistribution to poor people and farmers has not yet been implemented accordingly. Therefore, the gap in land ownership still exists.

According to Iwan, the government actually can take over the lands, which are not used accordingly, and subsequently redistribute them to the people. "The remaining 2.5 years is enough to prove the government's promise," he said. (Muhammad Farid/Translator)
